Denmark Pioneers Digital Identity Rights: Your Face, Voice & Body Become Your Intellectual Property

Denmark is making history as the first European country to propose a law granting citizens copyright over their own face, voice, and physical likeness. This legislative innovation reframes personal identity as intellectual property, aimed at combating unauthorized deepfake content generated by AI
Unlike traditional copyright systems, the proposed amendment grants automatic rights from birth—no registration needed. Citizens can immediately request the removal of unauthorized deepfake content using their likeness.
The bill introduces three key protections:
Removal Right: Demand content takedown if your face, voice, or likeness is used without consent.
Right to Compensation: Seek damages for misuses, regardless of actual harm or defamation.
Platform Liability: Platforms hosting illegal deepfake content may face significant fines if they fail to act promptly
Crucially, satire, parody, news, and public-interest content are expressly exempted
Ownership, Not Just Protection: Your facial features and voice are acknowledged as your personal property under law.
Proactive Enforcement: Individuals can act immediately—no need to prove emotional harm or defamation.
Digital Sovereignty: Platforms hosting deepfakes become accountable, aligning with the EU Digital Services Act.
As Denmark assumes the EU Council Presidency in 2025, it plans to champion this model across Europe
The Danish proposal marks a groundbreaking legislative shift in the relationship between identity and technology: in the generative AI age, recognizing that ‘You are your own intellectual property’ serves as a pillar of dignity and personal protection.
